LAWN MAINTENANCE SERVICE AGREEMENT
Effective Date: Upon engaging JS MOW PRO for Lawn Maintenance Services.
Parties: JS MOW PRO ("Provider") and the property owner/representative ("Customer") for the address listed on the approved Estimate ("Property").
1. Fee Structure & Schedule
- Fee Structure: Services are provided on a fee-for-service / pay-per-mow basis.
- Termination: Either party may cancel at any time with 7 days’ written notice (text/email). Customer is responsible for payment of all completed services.
- Service Frequency: Weekly, bi-weekly, or one-off as selected on the Estimate.
- Peak Season (May 1 – Sept 30): Weekly service strongly recommended for recurring clients.
- Winter Season (Dec 1 – Mar 1): Automatically reduces to once per month (minimum requirement to maintain active account status) unless "on-call" scheduling is requested.
- Delays: Provider may reschedule due to inclement weather, saturated turf, extreme heat, holidays, or equipment failure.
2. Scope of Services
- Included Services: Mowing, mechanical edging (sidewalks/curbs/driveways), string trimming around obstacles, blowing/cleanup of hard surfaces, and spot application of glyphosate herbicide to weeds in hardscapes/rock beds.
- Excluded Services (Available by separate quote): Flower bed weeding/mulching, bush/tree trimming, aeration, seeding, fertilization, pest control, and irrigation repair.
- Property Condition Accuracy: Property condition and lawn height must be honestly and accurately stated by the Customer. If the property condition is found to be inaccurate or severely overgrown upon arrival, the lawn will not be serviced until an updated estimate has been reviewed and approved by the Customer.
3. Customer Responsibilities
To ensure safety and efficiency, the Customer must do the following prior to service day:
- Clear the Property: Remove all toys, hoses, lawn furniture, pet waste, and debris. Provider is not responsible for damage to items left on the lawn.
- Secure Pets: Safely confine all pets indoors or away from the service area.
- Provide Access: Ensure gates are unlocked. If an area is inaccessible, it will not be serviced, and no discount will be applied.
- Disclose Hazards: Notify Provider in writing of hidden hazards (shallow irrigation lines, invisible dog fences, low cables, etc.).
4. Billing & Payment
- Timing: Invoices are sent upon service completion. Payment is requested by the end of the service day.
- Payment Methods: Credit/Debit Cards, ACH/Bank Transfer, Cash, and Cash App. (No credit card fees passed to Customer).
- Payment Options: 1. Invoice: Pay manually by end of day. 2. Auto-Pay (Preferred): Valid card kept securely on file for automatic billing upon completion. 3. Prepayment: Maintain a credit balance on account.
- Late Payment: Accounts 7 days overdue will be immediately suspended. To restore service, outstanding balances must be paid, and a card on file or prepayment will be required.
- Rate Adjustments: Provider may increase rates by giving 30 days’ advance written notice.
5. Liability & Legal
- Liability Limitations: Provider is not liable for pre-existing damage, damage to unmarked/hidden hazards, or damage caused by the Customer’s failure to clear the property. Normal wear and minor discoloration from routine trimming are to be expected.
- Indemnification: Customer agrees to hold JS MOW PRO harmless from claims or losses arising from Customer negligence or failure to maintain a safe work environment.
- General: This agreement and the approved estimate constitute the entire understanding between parties. Notices may be delivered via text or email. Governed by State law.
